PUBLIC OFFER
This Public Offer (hereinafter referred to as the "Offer") is an Agreement concluded between the Service Provider TOO "arqa AI", BIN 250640026643, and the user of services - an individual (hereinafter referred to as the "Customer"), which determines the conditions for the acquisition and provision of services using the Service Provider's resources.
GENERAL PROVISIONS
1. The Service Provider publishes this Offer with a proposal addressed to individuals and legal entities in accordance with Articles 395, 396, and 447 of the Civil Code of the Republic of Kazakhstan (hereinafter referred to as the "CC RK").
2. This Offer, like any Agreement, defines the essential conditions of interaction between the Service Provider and the Customer (the person who has accepted the Offer).
3. This Offer is concluded between the Service Provider and the Customer at the moment of placing an order for services.
4. The Offer can be accepted by any individual or legal entity in the territory of the Republic of Kazakhstan who intends to order (purchase) services provided by the Service Provider in accordance with the list of services specified on the Platform.
5. The Customer unconditionally accepts all conditions contained in the Offer in its entirety (i.e., in full and without exceptions).
6. In case of acceptance of the terms of this Offer, an individual or legal entity becomes the Customer.
7. Acceptance is the receipt by the Service Provider of a message about the intention of an individual or legal entity to order services on the terms proposed by this Offer.
8. The Offer, all amendments, appendices to it, as well as all additional information about the Service Provider's services are published on the Platform.
STATUS OF THE SERVICE PROVIDER'S PLATFORM
1. The Platform is the property of the Service Provider and is intended for organizing a remote method of selling services via the Internet.
2. By accepting the Offer (i.e., paying for an order placed on the Service Provider's Platform), the Customer will receive services under the terms and in the manner determined by the Service Agreement of the Service Provider, posted on the arqa.cc Platform.
3. The Service Provider is not responsible for the content and accuracy of information provided by the Customer when placing an order on the Service Provider's Platform.
STATUS OF THE CUSTOMER
1. The Customer is responsible for the accuracy of the information provided when placing an order, and its freedom from claims of third parties.
2. Information provided by the Customer is confidential. By providing their personal data, registering on the Platform, or filling out an application, the Customer, by their actions, gives consent to the processing of their personal data for the purpose of fulfilling the user agreement. The Service Provider uses information about the Customer exclusively for the purposes of the Service Provider's functioning (sending notifications to the Customer about order fulfillment, etc.) and in cases specified in this Offer.
SUBJECT OF THE OFFER
1. The Service Provider, based on the Customer's orders, sells the latter services in accordance with the terms and at prices established by the Service Provider on the Platform.
2. Provision of services ordered and paid for by the Customer is carried out by the Service Provider or third parties engaged by the Service Provider to fulfill their obligations.
3. The provisions of the CC RK, the Law of the Republic of Kazakhstan "On Consumer Protection", as well as other regulatory legal acts of the Republic of Kazakhstan regulating the rights and obligations of the Parties specified in this Offer apply to the relationship between the Customer and the Service Provider.
4. An individual or legal entity is considered to have accepted all the terms of the Offer (acceptance) and its appendices in full and without exceptions from the moment the Service Provider receives a message about the Customer's intention to order services on the terms proposed by the Service Provider. In case of acceptance of the Offer, an individual or legal entity is considered to have concluded a Service Agreement with the Service Provider and acquires the status of Customer.
PROCEDURE FOR CONCLUDING A SERVICE AGREEMENT
1. The Customer can place an order independently on the Service Provider's Platform.
2. When placing an order on the Service Provider's Platform, the Customer is obliged to provide the following data:
Full name
Address
Contact phone number
3. The Customer's will is expressed by entering the relevant data into the order form on the Service Provider's Platform.
4. The Service Provider does not edit information about the Customer, only at the request of the Customer themselves.
INFORMATION ABOUT SERVICES
1. Information about the Service Provider's services is provided for display on the Service Provider's Platform through graphic images and information that are the property of the Service Provider.
2. All information materials presented on the Service Provider's Platform are for reference purposes and cannot fully convey information about the properties and characteristics of services. If the Customer has questions regarding the properties and characteristics of services, the Customer must contact the Service Provider's specialist by phone numbers indicated on the Platform before placing an order.
3. At the Customer's request, the Service Provider's specialist is obliged to provide (by phone or via email) other information necessary and sufficient, from the Customer's point of view, for them to make a decision about ordering services.
PROCEDURE FOR PURCHASING (ORDERING) SERVICES
1. The Customer has the right to place an order for any type of service provided on the Service Provider's Platform. Each type of service can be ordered in any quantity. Exceptions to this rule are indicated in the description of each type of service.
2. An order can be placed by the Customer independently on the Platform.
3. If it is impossible to provide a service presented on the Service Provider's Platform, the specialist of the latter is obliged to inform the Customer about this (by phone or via email).
4. The term for providing the service is established by agreement of the Parties and/or determined by the Service Agreement posted on the Service Provider's Platform.
PRICE OF SERVICES
1. The price indicated on the Service Provider's Platform is stated in tenge of the Republic of Kazakhstan.
2. The price indicated on the Platform may be changed by the Service Provider unilaterally; however, the price for services ordered and paid for by the Customer is not subject to change.
3. The cost of services provided to the Customer when ordering them on the Service Provider's Platform is indicated when creating an order.
PAYMENT FOR SERVICES
1. Payment methods and procedures are indicated on the Platform when creating an order.
2. Cashless payment is made by debiting the amount (which was indicated when creating the order) from the card linked to the Customer's account.
3. The Customer pays for the order by any method available on the Service Provider's Platform.
4. Settlements between the Parties when paying for an order are carried out in tenge of the Republic of Kazakhstan.
REFUND POLICY
1. The Customer has the right to refuse services in the manner and under the conditions provided by the Law of the Republic of Kazakhstan "On Consumer Protection of the Republic of Kazakhstan".
2. The Customer does not have the right to refuse services performed (provided) in a proper manner.
3. When the Customer refuses services, the Service Provider returns to the Customer the amount paid by the Service Provider in accordance with the agreement, with the exception of the Service Provider's expenses.
LIABILITY OF THE PARTIES
1. The Parties are liable in accordance with the legislation of the Republic of Kazakhstan.
2. The Service Provider is not liable for damage caused to the Customer as a result of improper use by them of the results of services ordered on the Service Provider's Platform.
3. The Parties are released from liability for non-performance or improper performance of obligations under the Offer during the period of force majeure circumstances.
OTHER CONDITIONS
1. The norms defined by the legislation of the Republic of Kazakhstan apply to the relationship between the Customer and the Service Provider.
2. If necessary, the Service Provider and the Customer have the right at any time to execute a service agreement in the form of a written bilateral agreement that does not contradict the provisions of this Offer.
3. In case of questions and claims from the Customer, the latter must contact the Service Provider at the Service Provider's location address: Almaty, Bostandyk district, Satpayev Street 82, or at the email address: info@arqa.cc or by phone number: +7 706 668 04 95, including those specified on the Service Provider's Platform.
4. This Offer comes into force from the date of its acceptance by the Customer and is valid until the Parties fully fulfill their obligations under it.
5. All disputes and disagreements arising during the Parties' fulfillment of obligations under this Offer are resolved through negotiations, and if it is impossible to resolve them through negotiations, the Parties have the right to apply for resolution of such disputes to the judicial authorities of the Republic of Kazakhstan at the location of the Service Provider.
6. The Service Provider reserves the right to expand and reduce the overall offering of services in the mobile application, regulate access to ordering any services, as well as suspend or discontinue the sale of any services at its own discretion.
